It is in your best interest to file your tax returns, but we know there are many reasons why people cannot file; however, there are consequences when you do not file your taxes including substantial penalties and interest, and in the most extreme cases, prison. It is much better to file the return and not pay than to not file at all.

If you do not file a tax return, the IRS can file a substitute tax return for you (a Substitute for Return), but it could be missing important information (exemptions and expenses), which will lead to an overstatement of your tax liability. Most of the time, you can ask that the IRS reconsiders their assessment by giving them a copy of the tax return with more accurate numbers; it may or may not be accepted. If you have tax returns more than 6 years past due and that IRS has not filed returns for you, you are not required to file tax returns as the IRS has noted it to be too difficult to get records from that long ago.

If you have past due tax returns, you want to get them filled correctly as quickly as you can, hopefully before the IRS takes action against you to collect debt. If the IRS sees you are working
towards filing your taxes, your penalties may be lessened.

If you filed taxes with refunds due, you only have three years to claim the refund otherwise is becomes property of the U.S. Treasury and will likely not apply any credits to other tax years.
